These terms are the agreement between you and ArtMatch for your use of our website and the style quiz. They cover who can use ArtMatch, what you can expect from us, what we expect from you, and the legal basics. Agreement to these terms
ArtMatch is operated from Montréal, Québec, Canada. By visiting tryartmatch.com, joining the waitlist, taking the quiz, or otherwise using the service, you agree to these Terms of Service. If you don’t agree, please don’t use ArtMatch.
Who can use ArtMatch
ArtMatch is for adults. You may use it if you are old enough to form a binding agreement where you live (and at least 14). You’re responsible for the activity on your account and for keeping access to your email secure, since we sign you in with a magic link rather than a password.
What ArtMatch is
ArtMatch is a style-matching and art-discovery service. You take a short quiz, we build a style profile, and we surface artworks we think you’ll love. Where you want to take a work further, we help connect you with the artist or gallery. Today the service is in early access: you can join the waitlist and take the quiz, and we’re adding features over time.
Matches are suggestions to help you discover art. Taste is personal, and we don’t promise that any particular work will be available, to your liking, or a fit. The choice is always yours.
Your account and the quiz
When you take the quiz and give us your email, we create a style profile for you and can show your results across devices. You agree that the information you give us is accurate and that you’ll keep it up to date. You can ask us to delete your account at any time. See the Privacy Policy.
Acceptable use
When you use ArtMatch, you agree not to:
- Break the law, or infringe anyone's intellectual property or privacy.
- Upload content that is unlawful, infringing, deceptive, or that you don't have the rights to.
- Scrape, copy, or harvest the catalogue, data, or images except as the service plainly allows.
- Reverse-engineer, probe, or interfere with the service, or try to get around its security, rate limits, or bot protection.
- Use ArtMatch to send spam, or to impersonate anyone.
- Upload anything that contains malware or is designed to disrupt the service.
We may suspend or limit access to keep ArtMatch safe and working for everyone.
Content you provide
Room photos and messages
Some features let you give us content, for example, a photo of your room for View-in-Room, or a message to our art curator. You keep ownership of what you provide. You grant ArtMatch a limited, non-exclusive licence to use that content only to provide the feature you asked for (such as rendering your preview), and you confirm you have the right to share it.
Artists and galleries
If you submit a work for consignment, you confirm that you own or have the rights to it and to the images you provide, and that you may offer it. A submission is an offer to be considered, not a binding agreement. We may accept or decline it, and a separate consignment agreement will govern any work we take on.
Intellectual property
ArtMatch (the website, the quiz, the matching system, our design, and our name and marks) belongs to us or our licensors and is protected by law. Artwork and images shown on ArtMatch belong to the artists, galleries, or rights holders who created or supplied them. We grant you a personal, non-transferable right to use ArtMatch for your own, non-commercial discovery of art. Nothing here transfers ownership of any artwork or of our or others’ intellectual property to you.
Email and communications
We’ll send you transactional messages you need (such as your sign-in link and confirmations), and, if you’ve opted in, news about launch and new work. You can unsubscribe from marketing email at any time using the link in the message. Consent and your choices are covered in the Privacy Policy.
Third-party links and services
ArtMatch may link to artists, galleries, or other websites and services we don’t control. We’re not responsible for their content, products, or practices, and your dealings with them are between you and them.
No financial advice
ArtMatch helps you discover and acquire art you love. It is not a financial, advisory, or appraisal service, and nothing on ArtMatch is financial, tax, or legal advice. We make no representations or warranties about the monetary value of any artwork. Decisions to acquire art are yours alone.
The service is provided “as is”
We work hard to make ArtMatch useful and reliable, but we provide it “as is” and “as available.” To the extent the law allows, we don’t make warranties that the service will be uninterrupted, error-free, or that the matches will suit you. Some jurisdictions, including Québec, don’t allow certain warranties to be excluded. In that case, those rights still apply to you.
Limitation of liability
To the fullest extent permitted by applicable law, ArtMatch and the people behind it won’t be liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms limits liability that can’t be limited by law, including under Québec’s consumer-protection rules, and nothing here takes away rights you have as a consumer that can’t be waived.
Changes to the service and these terms
ArtMatch is evolving, so we may add, change, or remove features. We may also update these terms. When a change is material, we’ll update the effective date above and, where appropriate, tell you directly. If you don’t agree with an updated version, you can stop using ArtMatch and ask us to close your account. Continuing to use it after a change means you accept the updated terms.
Suspension and termination
You can stop using ArtMatch at any time and ask us to delete your account. We may suspend or end your access if you break these terms or to protect the service or other people. The parts of these terms that should reasonably survive (such as intellectual property, the disclaimers, and the sections below) continue after your access ends.
Governing law
These terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Any dispute will be brought before the courts of the judicial district of Montréal, Québec, except where the law gives you, as a consumer, the right to bring it elsewhere. This doesn’t prevent you from using a dispute-resolution body available to you under applicable law.
Language
You and ArtMatch have requested that these terms and all related documents be drawn up in English. Les parties ont demandé que la présente convention et tous les documents connexes soient rédigés en anglais. A French version is available on request.
